Terms and Conditions
Unless otherwise agreed in writing or email, all orders are accepted subject to the following terms and conditions. Any special conditions printed on the client's order will not be accepted if they are at variance with our own.
Domain Names
The title of the domain names ordered remain the property of MCL Web Solutions until full payment has been received. Title will then pass to the client upon cleared funds. Once ordered, domain names cannot be altered and no refunds are available. Client's are reminded to be very careful in the spelling of domain name requests, as no responsibility can be undertaken for client's errors.
Prices
All prices displayed on our website are subject to alteration at any time without notice, unless confirmed for an agreed period between the client and MCL Web Solutions. Specific quotes are available in writing and email with guaranteed pricing valid for a maximum of thirty days from the date the estimate is submitted.
Payment
For orders below £300, full payment must be received from the client to MCL Web Solutions before any work commences. For order above £300, the client can request to pay in two instalments, which must be confirmed in writing or email by MCL Web Solutions outlining the agreed terms of payment. MCL Web Solutions reserves the right to decline any request of instalment payments from any client, providing them with an explanation of the decline in writing or email.
Website
Title of the website will pass to the client once all outstanding invoices have been settled in full, FTP access along with all necessary passwords, etc. will also be forwarded. It is advisable for clients to follow all instructions issued by MCL Web Solutions to ensure that their website remains intact and available to the public at all times. MCL Web Solutions may charge an additional fee should it be necessary to rectify a problem caused by the client, which would become payable in advance.
Website Pages
- Commercial use of Web and FTP space is permitted.
- The client will be responsible for the content of their pages, including obtaining the legal permission for any works they include and ensuring that the contents of these pages do not violate UK law.
- The client will be held responsible for and accept responsibility for any defamatory, confidential, secret or other proprietary material available via their web pages.
- We reserve the right to remove material deemed inappropriate from the client's website, without prior notice. MCL Web Solutions do not allow any illegal or adult orientated material to be hosted on their servers.
Hosting
- All hosting packages will be hosted on MCL Web Solutions' top quality servers.
- MCL Web Solutions will only sell web hosting if our servers are capable of handling the clients' hosting requirements. This results in a quality run server with 99.9% performance uptime.
- All of our hosting packages are set out on our Hosting Packages page.
- If any client requires a hosting package that differs from the set packages then they must request a quotation.
Refunds
Domain Name Registration -
- MCL Web Solutions will not give any refunds for domain name registrations.
- A full refund will be given only if MCL Web Solutions has registered a domain name under a different name than provided by the client.
Hosting -
- If a client takes out a yearly hosting package we expect them to commit to this period of time. If they cancel their account within this service period then MCL Web Solutions will not make any refunds on any unused portions of their account. If the client has paid for more than one years hosting and wishes to cancel their hosting package with MCL Web Solutions within the first 12 months, then a 50% refund will be given for the remaining years after the first 12 months.
- If the client has set up a monthly hosting subscription then no refund will be given if they decide to cancel. They do have the right to cancel at anytime, however we will not be held responsible for any loss of data or website.
Web Design -
- MCL Web Solutions offer 100% satisfaction on any web design project. The website will be designed to the client's exact requirements. After the website has been completed then MCL Web Solutions will provide the client with two chances to make any modifications. If the client requires further alterations to their website after the two alterations, then this will be charged for.
- If work has not started on the client's website project then a refund of 90% will be given. The 10% will be retained by MCL Web Solutions for order processing fees.
- If the design process has started and the client requests a refund, then a refund of ONLY 25% will be given. This is due to the amount of work done during the design process.
- If the client has confirmed their satisfaction with the finished website then MCL Web Solutions will not give any refunds for any web designing services.
General Terms
- We do not allow any illegal material to be hosted on our servers.
- These accounts may not to used to host a collection of MP3's, Warez, or to backup your computer or another source.
- You may not use your hosting account for general storage of any type.
- All content stored on your hosting account must be directly used on the internet by the website associated with that account.
- Your hosting account may not be used as a download distribution point for your software or media.
- All accounts are to be used for standard web practices only. This means that all content stored on your account must be used for "acceptable" website use only.
- All data stored in your hosting account must be directly related to your website.
- You may not store more data in your account than your allocated disc space.
- You must not divulge access passwords to any other person, and you should take reasonable precautions to ensure that it is not discovered by other people.
- Data stored on our servers is not guaranteed to be backed up. It is recommended that you keep an independent backup of all your data and files stored on our servers.
- We shall not be held liable for any loss or damages caused by the use or misuse, unavailable or removal of services. This includes domains which have expired, which clients have not paid the renewal fees.
- We will not be responsible for any downtime caused by third party providers, including domain name registrars.
- When your account is closed, all files (including web pages, graphics, etc.) will be deleted.
- We reserve the right to amend and update these Terms and Conditions at any time without notice.
- To protect your privacy we never distribute your name or email address to any third parties. Please see our Privacy Policy for further details.
- Users must not participate in any form or un-solicited bulk emailing or spam. This will not be tolerated and anyone caught will have their account and website deleted from our servers.
- By logging into your account, or uploading files to it, you are indicating your acceptance of these Terms and Conditions.
- We reserve the right to cancel your account at any time without notice if we find that any of these terms have been broken.
